Registration Policy
1. Registration
A non-refundable registration fee will be due to the nursery on submission of the completed registration form.
2. Acceptance Offer
The deposit is due to the nursery on the acceptance of the offer and the deposit will be non-refundable unless one full month's written notice is given to the nursery manager. The deposit is not deductable from the first month's fees.
3. Fee Payments
Payment of nursery fees for the child's attendance at the nursery shall be made by the parent/guardian monthly, in advance, on the first day or each month (on the due date)
If the payment of nursery fees becomes outstanding for more than 14 days then the nursery may serve 14 days written notice to terminate the contract. Upon termination of this contract the child will not be admitted to the nursery, and the nursery's notice to terminate shall be regarded as a formal demand for outstanding monies.
The nursery reserves the right to increase the fees at any time by giving one calendar month's written notice of the proposed months increase.
4. Fee Calculations
The nursery closes for one week at Christmas and all other Bank Holidays
The fees payable are calculated by taking the child's weekly attendance fee, multiplying the same by 51, being the number of weeks the nursery is open and dividing by 12 to give a monthly payment fee. The nursery does not accept the payment of fees on a daily or weekly basis. Any payments made in this way may be regarded by the nursery as a breach of payment obligations and the nursery reserves the right to terminate this agreement upon serving 14 days notice of payment default. If upon the expiration of the 14 days notice the fees are still outstanding the nursery will be entitled to treat this agreement as terminated and the provision of clause 3 paragraph 2 shall apply.
The nursery does not permit the pro-rata reduction of payment fees if the child is absent from the nursery due to illness or holidays whilst the nursery is open. The parent/guardian is therefore obliged to make full payment. In the event of payment not being made, the nursery reserves the right to terminate. See clause 3 paragraph 2.
5. Cancellation/Termination
After an offer has been made by the nursery but before acceptance by the parent/guardian either party may cancel the offer by serving 7 days written notice.
After acceptance of the offer by the parent/guardian either party may terminate this agreement by giving one calendar month's notice in writing. During the one month period, the nursery undertakes to continue to admit the child and the parent/guardian undertakes to pay all fees due. In the event of the parent guardian/failing to pay the month's fees the child's place shall be immediately withdrawn and the nursery will be entitled to serve a formal demand for payment of such monies.
Should the parent/guardian give notice to withdraw the child and immediately withdraw the child from the nursery, there will be due one calendar month's fees in lieu of notice. Failure by the parent/guardian to provide one calendar month's notice (or any notice at all) will mean the parent/guardian liable to pay a month's fee.
Notice must be in writing and posted to the nursery manager.
If in the reasonable opinion of the nursery manager or person with the delegated authority considers that the continued presence of the child referred to is detrimental to the health, safety and or well being of a child, children, teachers or other staff employed by the nursery, then the nursery may serve notice to the parent/guardian or request for the child to be immediately removed from the nursery and the provision of one month's notice as referred to in paragraph 2 shall not apply.
6. Non-solicitation of staff
During the time of the child's attendance at the nursery and for a period of six months following the termination of the child's attendance at the Hill Nursery, the parent/guardian will not attempt to employ or entice away any persons employed or formerly employed by the Hill Nursery. In the event of a breach of this agreement the parent/guardian will cover all costs incurred relating to the recruitment, selection and administrative process necessary to replace the staff member(s) in question. Costs will include but will not be limited to advertising, management time, interviewing, agency and legal fees.
7. Variation
There shall be no variation of this agreement unless it is in writing and made between a duly authorised representative of the nursery and the parent/guardian. Employees of the Hill Nursery are not authorised to vary any of the terms of this policy, particularly in the following specific areas:
a) The variation of any terms within this policy except the attendance schedule.
b) The entering into of agreements be they oral or written with the parent/guardian relating to payment schedules of current fees or arrears
c) The acceptance of any offer relating to the payment of fees or arrears other outside of clause 3.
d) Any representation as to the rights of the Hill Nursery to take legal or other proceedings.
Any variations to the agreement will be notified in writing from the Director of the Hill Nursery.
8. Acceptance
The above terms and conditions are considered to be fair and reasonable. In the event of any term found by a Court of Law to be unreasonable then the clause will be removed but the agreement will remain in full force and effect. The parent/guardian has read and understands the nursery policy and undertakes to comply with the terms accordingly.
